General terms and conditions of sale
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by LABORATOIRE AMESA, a simplified joint-stock company (SAS) with a capital of €50,000.00, whose registered office is located in PARIS (75011) – 3 rue Keller, registered with the Paris Trade and Companies Register under number 922 459 664 (hereinafter "the Seller") with consumers and non-professional buyers (hereinafter "The Customers" or "The Customer"), wishing to acquire the products offered for sale by the Seller (hereinafter "The Products") on the website https://labote.com.

These General Terms and Conditions of Sale apply to the exclusion of all other conditions, including those applicable to sales in stores or through other distribution and marketing channels.
These general terms and conditions of sale are accessible at any time on the website https://labote.com and shall prevail, where applicable, over any other version or contradictory document.
The Client declares that they have read these Terms of Use as well as the general terms of use of the website https://labote.com.
These General Terms and Conditions of Sale may be subject to subsequent modifications; the version applicable to the Customer's purchase is the one in effect on the website on the date the order is placed.
The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the website https://labote.com.
The Customer is required to read this before placing any order.
The choice and purchase of a Product is the sole responsibility of the Customer.
The photographs and graphics presented on the website https://labote.com are not contractual and do not constitute a binding commitment on the part of the Seller.
The Customer is required to refer to the description of each Product in order to know its essential properties and characteristics.
Product offers are subject to availability, as indicated when the order is placed. Should a product become temporarily or permanently unavailable, the Seller will inform the Customer by email.
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.
The validation of the order by the Customer constitutes acceptance without restriction or reservation of these General Terms and Conditions of Sale.
Article 1 – Customer Capacity
The Customer acknowledges having the legal capacity to enter into a contract and purchase the Products offered on the website https://www.labote.com
Article 2 – Order
It is up to the Customer to select the Products they wish to order on the website https://labote.com.
The contractual information is presented in French and is subject to confirmation no later than when the order is validated by the Customer.
Product offers are valid as long as they are visible on the website, subject to available stock.
The sale will only be considered final after the Seller sends the Customer confirmation of acceptance of the order by email and after the Seller has received full payment.
An order is registered on the website https://labote.com when the Customer validates their order. In accordance with Article 1172-2 of the French Civil Code, the Customer has the opportunity to review the details of their order, its total price, and correct any errors before confirming their acceptance. This validation implies acceptance of all of these General Terms and Conditions of Sale and constitutes proof of the sales contract. It is therefore the Customer's responsibility to verify the accuracy of the order and to report any errors immediately.
Consequently, any order placed on the website https://labote.com constitutes a distance contract between the Customer and the Seller. The Customer may request a delay in the shipment of their order for up to 10 days from the date they placed the order on the website https://labote.com. This request must be made in the " Instructions for preparing your order? " field at the time of order confirmation, or by email within 30 minutes of confirming the order.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute concerning payment for a previous order, or if the Customer presents a high risk of default. In such cases, the Seller reserves the right to request additional information from the Customer, such as a valid form of identification or proof of address. If the outstanding amount is not paid within five days of the order being placed, the Seller reserves the right to cancel the order.
The Customer will be able to track the progress of their order on the website https://labote.com.
Finally, in the event of a cancellation due to a temporary or permanent unavailability of the products, the Seller undertakes to reimburse the Customer as soon as possible.
Article 3 – Prices & Payment
The Products are supplied at the prices in effect on the website https://labote.com at the time the Seller registers the order. Prices are expressed in Euros, inclusive of all taxes.
It should be noted that any change in the applicable VAT rate will automatically be reflected in the price of products sold on https://labote.com.
The prices take into account any discounts that may be offered by the Seller on the website https://labote.com.
These prices are fixed and non-revisable during their period of validity, as indicated on the website https://labote.com, the Seller reserves the right, outside this period of validity, to modify the prices at any time.
It is also specified that these prices do not include processing, shipping, transport and delivery fees, which are charged in addition, under the conditions indicated on the website https://labote.com and calculated prior to placing the order.
Furthermore, any bank charges (such as exchange commissions) remain the responsibility of the Client (including in the event of a refund).
The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.
The price is payable in full on the day the order is placed by the Customer, by Visa, MasterCard and Carte Bleue type bank cards via the secure payment platform PayPlug.
Bank details are only transmitted over the Internet in encrypted form and are never stored by the Seller.
The customer's order may be subject to 3D Secure verification. 3D Secure is an authentication payment system that ensures optimal security for online purchases.
During payment, the Client's bank verifies the identity of the cardholder before validating the transaction.
To protect itself against fraudulent practices, the Seller verifies orders placed on its website. As part of this verification process, the Seller's customer service department may request supporting documents from the Customer, such as proof of address or the name of the person listed for the delivery address, etc.
It is specified that the card is debited at the time the order is validated.
The Seller will not be obliged to deliver the Products ordered by the Customer if the Customer does not pay the full price under the conditions indicated above.
Payments made by the Customer will only be considered final after the Seller has effectively received the sums due.
Furthermore, the Seller reserves the right, in the event of non-compliance with the payment conditions set out above, to suspend or cancel the delivery of pending orders placed by the Customer.
Article 4 – Delivery
Delivery consists of the transfer to the Customer of physical possession or control of the Product.
Except in special cases or if one or more Products are unavailable, the Products ordered will be delivered in a single shipment.
Deliveries are made by La Poste "Colissimo" or Mondial Relay for all of France or by courier in Paris.
In this regard, it is specified that delivery times may vary depending on the destination.
In the event of a shipping delay, Laboté will inform the customer of a new delivery date. In accordance with Article L. 216-1, paragraph 2 of the French Consumer Code, Laboté commits to respecting the maximum delivery period of 30 days from the date of the contract. Delivery delays within the legal 30-day period do not entitle the customer to any penalties or compensation, nor do they justify cancellation of the order.
For your information, here are the usual delivery times provided by La Poste via Colissimo or Mondial Relay, as well as the delivery charges applied (after shipment of our products).
France: less than or equal to 5 working days.
For Mondial Relay, shipping costs are charged at €4.90 for any purchase strictly less than €59, above that, they are free.
For Colissimo, Shipping costs are charged at €6.90 for any purchase strictly less than €79, above that, they are free.
Europe (Belgium, Italy, Spain, United Kingdom, Luxembourg, Germany, Portugal, Switzerland, Ireland) : less than or equal to 8 working days, shipping costs are €10 (excluding customs fees) regardless of the total order amount.
Europe (Other) : For countries not listed, please contact Laboté customer service to see the feasibility and conditions.
Article 5 – Click & collect
The company Laboté is implementing click & collect, allowing customers to pick up their products directly in store.
The shop located at 3 rue Keller 75011 Paris will be open for click & collect from Monday to Saturday from 11am to 7pm except public holidays.
To collect your package, Laboté reserves the right to request an order number and proof of identity.
Article 6 – Transfer of Ownership
Ownership of the Seller's Products will only transfer to the Customer after full payment of the price by the Customer, regardless of the delivery date of said Products.
Regardless of the date of transfer of ownership of the Products, the transfer of risk of loss and damage relating thereto shall only take place when the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk.
Article 7 – Right of withdrawal
The sale is considered final upon order confirmation and full payment. However, the right of withdrawal begins upon collection of the item in the case of a click & collect order, or upon delivery of the goods.
Pursuant to Article L. 221-28 3° of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized.
The following Laboté products are custom-made, handcrafted, and made to order according to the Client's specifications; therefore, the Seller does not accept returns, except in the case of a defective product. The following are the custom-made products for which returns are not possible:
- Laboté's custom-made day creams
- Laboté's custom-made night creams
- Laboté's bespoke floral infusions
- Laboté's custom-made serum
- Laboté's bespoke body treatment
- Laboté's custom-made night oil
- Laboté custom-made eye contour
Other Laboté products are subject to the legal right of withdrawal, which is 14 days from the day after purchase by the consumer. In this case, the customer is obligated to return the UNUSED product, in its original packaging, without delay, as evidenced by the postmark. The refund will then be issued within 14 days of Laboté receiving the returned product(s) at the address: 3 rue Keller, 75011 Paris, France.

Article 8 – satisfied or reformulated
In order to ensure maximum customer satisfaction, Laboté offers a guarantee in addition to the right of withdrawal mentioned in article 7 of its General Terms and Conditions.
- “Satisfied or reformulated”: The company Laboté undertakes, at the request of the customer, and after validation by a Laboté expert during a consultation, to reformulate the so-called “made-to-measure” products brought back to the store or returned within fourteen days after receipt by the customer of the order, postmark serving as proof if the products prove to be poorly tolerated by the customer.
The reformulation will then take place within fourteen days of the recovery of the product(s) by Laboté, at the address of 3 rue Keller, 75011 Paris.
Article 9 – Seller's Liability – Warranty
The products sold on the website https://labote.com comply with the regulations in force in France and have performance levels compatible with non-professional uses.
The Products supplied by the Seller benefit, by right and without additional payment, independently of the right of withdrawal, in accordance with legal provisions,
- the legal guarantee of conformity, for Products that are apparently defective, damaged or do not correspond to the order,
- the legal guarantee against hidden defects arising from a defect in material, design or manufacturing affecting the delivered products and rendering them unfit for use.
It is recalled that under the legal guarantee of conformity, the Customer has a period of two years from the delivery of the goods to take action against the Seller; the Customer may choose between repair or replacement of the ordered Product, subject to the cost conditions provided for in Article L 217-9 of the Consumer Code.
The statutory warranty of conformity applies independently of any commercial warranty that may cover the Product. The Customer may choose to invoke the warranty against hidden defects in the Product in accordance with Article 1641 of the Civil Code; in this case, they may choose between rescinding the sale or obtaining a reduction in the sale price in accordance with Article 1644 of the Civil Code.
In order to assert his rights, the Customer must inform the Seller, in writing, of the non-conformity of the Products within a maximum period of 14 days from the delivery of the Products or of the existence of hidden defects within the aforementioned periods and return or bring back to store the defective Products in the condition in which they were received with all the elements (accessories, packaging, instructions...).
The Seller will refund, replace or repair Products or parts under warranty deemed non-compliant or defective.
Shipping costs will be refunded based on the invoiced rate and return costs will be refunded upon presentation of proof of payment.
Refunds for Products deemed non-compliant or defective will be made as soon as possible and at the latest within 14 days of the Seller's confirmation of the non-compliance or hidden defect.
The refund will be made by credit to the Client's bank account or by bank check sent to the Client.
The Seller shall not be held liable in the following cases:
- failure to comply with the legislation of the country in which the products are delivered, which it is the Client's responsibility to verify,
- in case of misuse, use for professional purposes, negligence or lack of maintenance by the Customer, as well as in case of normal wear and tear of the Product, accident or force majeure.
In the event that the customer did not go to the collection point or post office and the package was returned, they can request to have the package reshipped by paying the shipping costs again or to be refunded the amount of the order excluding the shipping costs.
